What is the process?

Forming a Limited Liability Company (LLC) involves several steps. Although the specific requirements may vary slightly from state to state, the general process is similar. Here’s a step-by-step guide to forming an LLC:

Select a Name for Your LLC

Your LLC’s name needs to be unique and not used by any other company in your state. It must also typically end with an indicator like “LLC” or “Limited Liability Company”. StartGlobal as a first step will do the name check in the state to make sure it’s available. If the name you provided during signup is not available, we’ll reach out to you for alternate names. You can also update this from your StartGlobal dashboard. This process will be usually completed on the same day you make the payment.

Registered Agent

A registered agent is a business entity responsible for receiving important legal documents on behalf of your LLC. The registered agent must be located in the state where your LLC is registered. StartGlobal will be taking care of your Registered Agent requirement in the state and will appoint a Registered Agent for you. All documents, SOPs recieved by the Registered Agent will be sent to you via email and also be available under Mails in your StartGlobal dashboard. This will be automatically apointed once you start the business.

File the Articles of Organization

This is the formal document needed to officially form your LLC. It generally includes information like your LLC’s name, its purpose, and the name and address of the registered agent. This must be submited to the Secretary of State in the state where you want to form your LLC, along with a filing fee. The fee varies by state. StartGlobal will be completely taking care of the preparation of your document and deligently filing your document in the state and paying all included fees. This process will be usually done on the same or next working day, and we’ll get the filing back in a couple of days.

Obtain an EIN

The last step in the business formation process is getting your business bank account setup. StartGlobal partners with multiple banks and makes this process as seamless as possible. In many cases like Mercury bank account, StartGlobal will already send your data to Mercury using our internal systems, and your bank account will be ready to be activated. This process happens immedialy after the EIN is issued within 24 hours, and you can click Activate Bank account from your dashboard to complete the bank account setup.

Create an Operating Agreement

An operating agreement is not always required by the state, but it’s highly recommended. This document outlines the ownership structure and member roles within the LLC. It specifies how profits will be distributed, how major business decisions will be made, and the procedure for handling the departure and addition of members. This is an optional package in StartGlobal, but if you prefer to do it with StartGlobal, we’ll help you with a set of questionairres and setting up a fully custom Operating Agreement for you. Each of the owners can also sign this digitally and keep a record in your StartGlobal dashboard. There are many providers who give you a template document, we highly recommed you avoid the templates and use a custom version that actually fit the needs of your business.

We hope this was helpful to understand the process of your LLC formation. Overall we expect the process to take 30 days or less.
