When is a name too close to one already registered?

This is what catches most filings. Kansas compares your name against what is already on the register, and a difference that looks obvious to you may not count.

Our comparison cannot judge: Repeated or dropped letters. Texas treats "Texxas Strong" as the same name as "Texas Strong". Words that sound alike. Texas treats "Xpress Auto" as the same as "Express Auto". Words that mean the same thing in another language, where the state translates them. Anything the filing officer decides at their own discretion, which every state reserves.

Searching the official register

  • • Kansas expressly allows a member or manager’s own name in the company name
  • • It also expressly allows Company, association, club, foundation, fund, institute, society, union, syndicate, limited and trust, or abbreviations of like import. "Trust" being permitted outright puts Kansas with Delaware rather than with California, which bans it, or New York, which needs the financial regulator to consent
  • • K.S.A. § 17-7920 sets out what a name must and may contain but does not itself state a distinguishability test, so confirm availability with the Secretary of State before relying on it
